The Western Cape High Court's full bench, in City of Cape Town v Pro Khaya Construction, set aside a JBCC adjudication determination after finding the adjudicator ruled on extension-of-time claims and final-account items never raised in the original notice of adjudication. The court held jurisdiction is fixed by the notice itself, not later referral submissions, and that a late response cannot amount to acquiescence, guidance seen as relevant beyond JBCC to FIDIC, NEC and GCC contracts.
